Simpleyy Dev Marketplace: Terms of Service
1. Acceptance of Terms
By utilizing the services and website of Simpleyy Dev, you are consenting to these complete Terms of Service. Please review them thoroughly and retain a copy for your records.
Simpleyy Dev is an online platform facilitating the licensing and purchase of digital assets. Simpleyy Dev does not claim ownership or any rights to the digital products themselves; these remain the property of the original author(s) or Creator(s). Our role is solely to promote and make these products available on our platform.
2. Your User Account
To access our Services, account registration is mandatory.

| Age Restrictions | Users under 18 require permission from a parent or guardian. All users must be at least 13 years old to comply with payment processor requirements. |
| Right to Refuse | Simpleyy Dev and its associated entities reserve the right, at their sole discretion, to deny service, close accounts, modify content, or cancel transactions. |
| Profile Conduct | You must not use language that is offensive, vulgar, threatening, or violates intellectual property rights. Profile names and images must be chosen responsibly. |
| Account Responsibility | The individual whose billing information is associated with a multi-user account is ultimately responsible for all activity. Accounts are non-transferable. |
| Security | You must keep your account password secure, as you are responsible for all activity. |
| Relationship Status | These Terms do not establish any legal relationship of agency, partnership, joint venture, employment, or franchise between you and Simpleyy Dev. |
3. General Use of Services
3.1 Service Licensing and Conduct
We grant you a limited, non-exclusive, non-transferable, and revocable license to use our Services, subject to the following rules:

| Financial Obligations | You are responsible for settling all fees owed to Simpleyy Dev and for collecting/remitting any applicable taxes related to your sales or purchases via the Services. |
| System Integrity | You must not attempt to harm or disrupt our systems, including distributing harmful code (viruses) or using methods like crawling, scraping, or reverse engineering the Services’ source code. |
| Feedback Submission | Any unsolicited ideas or feedback you provide (excluding your actual product content) is considered non-confidential and non-proprietary. You grant us a worldwide, royalty-free, perpetual license to use and publish these materials for any purpose without compensation. |
| Digital Communication | By using our Services, you consent to our Electronic Communications pledge, meaning we will send you legal information electronically, and your digital agreement holds the same validity as a written signature. |
3.2 Account Management, Suspension, and Appeals

| Self-Termination | You can close your account via your settings at any time. This does not remove content posted prior to termination, and you remain liable for any outstanding bills. |
| Termination by Simpleyy Dev | We may suspend or terminate your account and access at any time, for any reason, without prior notice. You have no legal right to continued use. This may result in the loss of all associated account data and content. |
| Temporary Suspension | Accounts may be temporarily suspended if products or actions appear to violate Terms. You will be notified and given 7 working days to supply requested information (e.g., product licensing). Failure to reply will lead to full suspension. |
| Appeals | If you believe your account was suspended unfairly, you may appeal by contacting support@simpleyydev.com or reaching out via our official community channel. |
3.3 Content Moderation and Infringement
Simpleyy Dev reserves the right, at its sole discretion, to review and remove any of your content for reasons including (but not limited to): quality, DMCA notices, unauthorized content, misleading information, offensive material, infringement of third-party rights, or content that may cause liability.
Digital Millennium Copyright Act (DMCA): Simpleyy Dev respects intellectual property. If you believe any content infringes your rights, please use the on-site reporting feature or contact dmca@simpleyydev.com.
4. Purchasing Products
When you make a purchase, you are acquiring a license or grant of rights to use the digital product, not the ownership of the product itself. Use must comply with the terms of the license granted by the Creator.

| Availability | Product availability is not guaranteed indefinitely. You are encouraged to download and save your purchase in a secure location. |
| Usage | You agree to use the product as intended and per the licensed rights. You must not redistribute, resell, or share products without specific authorization from the purchased license. |
| Taxes & Fees | You are responsible for paying all levied taxes, fees, and charges associated with your use of the marketplace (e.g., withholding tax). |
| Payment Security | Simpleyy Dev does not store your card details; they are securely managed by a third-party payment processor (Stripe). Personal details stored are outlined in our Privacy Policy. |
| Refunds | Only the buyer may request a refund, and only the Creator can issue partial or full refunds. Buyers have 10 days to request a refund if the product does not function as intended or does not match its description. They must first contact the Creator, and if no response is received within 7 business days, they may then submit a refund request to Simpleyy Dev for review—however, Simpleyy Dev cannot force a Creator to refund and can only mediate. |
5. Selling on the Marketplace (For Creators)
Simpleyy Dev provides the Services to commercialize your digital content through the Site. All your content must comply with these Terms, and Simpleyy Dev may remove non-compliant content at its discretion.
5.1 Creator Requirements and Responsibilities

| Payment Receiving | A valid PayPal account is required to receive payouts. |
| Product Compliance | You must adhere to all requirements in the Product Guidelines. |
| Support | You must offer a reasonable level of support for your products. Inadequate support may lead to product removal or account termination. |
| Age | You must be at least 16 years old, or 13 years old with explicit parental/guardian permission. |
| Account Status | A registered Simpleyy Dev account is required. |
| Malware | Products must be free of malicious software, viruses, or code designed to cause harm. |
| Third-Party Rights | Products must not infringe on any third-party rights (e.g., copyright, trademark, rights of publicity). |
5.2 Content and Liability

| Your Content (YC) | All content posted through our Services is Your Content. You are solely responsible for your YC, guaranteeing you have all necessary rights and that posting it does not violate any third-party rights. |
| Inappropriate Content | You must not post YC that is abusive, threatening, defamatory, obscene, vulgar, or otherwise offensive. You also agree not to post false or misleading content, or use the Services in a fraudulent manner. |
| Exclusivity | Simpleyy Dev does not enforce an exclusivity policy. You are free to sell your products on other marketplaces or channels. |
| Product Acceptance | Each submitted product will be reviewed before acceptance into the marketplace. We reserve the right to refuse any product submission for any reason at our sole discretion. |
5.3 Payments, Fees, and Fraud

| Merchant of Record | Simpleyy Dev acts as the Merchant of Record, handling all transactions and payment collection, and then paying you earnings based on sales. |
| Payouts | All funds are initially held in the Simpleyy Dev registered Stripe account. Sellers can request a withdrawal, which is processed in approximately, but not limited to, 168 hours. |
| Fees | 15.49% platform fee per sale, plus 2.61% processing. Withdrawals include a 2% fee, and any additional PayPal regional fees. |
| Fee Changes | Simpleyy Dev will notify users via email 7 working days prior to implementing any fee changes. |
| Fraud & Refunds | If a fraudulent purchase occurs (e.g., with a stolen card), a refund will be issued to the rightful owner. Any commissions paid/projected to be paid to you from that fraudulent sale will be removed/deducted from your future earnings until Simpleyy Dev is fully reimbursed. |
5.4 Product Support
As a Creator, you are responsible for providing adequate and reasonable support to all your customers.
Reasonable support means: actively answering customer questions, attempting to resolve product issues, and generally working toward resolving any problems that arise with your uploaded products. Customer support is primarily handled through your Simpleyy Dev Inbox.
6. Disclaimers and Liability Limitation
6.1 No Warranties
SIMPLEYY DEV AND/OR ITS CREATORS PROVIDE NO REPRESENTATION REGARDING THE SUITABILITY, RELIABILITY, AVAILABILITY, TIMELINESS, OR ACCURACY OF THE INFORMATION, SOFTWARE, PRODUCTS, SERVICES, AND RELATED GRAPHICS ON THE WEBSITE.
ALL SUCH ITEMS ARE PROVIDED “AS IS” WITHOUT WARRANTY OF ANY KIND. SIMPLEYY DEV AND ITS CREATORS DISCLAIM ALL IMPLIED WARRANTIES AND CONDITIONS, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
6.2 Limitation of Liability
IN NO EVENT SHALL SIMPLEYY DEV AND/OR CREATORS BE LIABLE FOR ANY DIRECT, INDIRECT, PUNITIVE, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES WHATSOEVER (INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF USE, DATA, OR PROFITS).
This limitation applies to any damages arising from:
- Use or performance of the website/Services.
- Delay or inability to use the website/Services.
- Failure to provide services, or for any information/products/services obtained through the website.
- Any other issues arising from the use of the website, whether based on contract, tort, negligence, strict liability, or otherwise, even if Simpleyy Dev/Creators were advised of the possibility of damages.
YOUR SOLE AND EXCLUSIVE REMEDY if you are dissatisfied with any portion of the website/Services or these Terms is to discontinue using the website and Services.
